Terms of Use

1. Acceptance of Terms

By using ArtificialStory, you acknowledge that you have read, understood, and agreed to these Terms of Use. This End-User License Agreement (EULA) is concluded between you and ArtificialStory, not Apple. ArtificialStory provides an AI-powered story creation service for personal use only. If you do not agree to these terms, you must discontinue use of the app immediately.

2. Scope of License

The license granted to you for ArtificialStory is a non-transferable, limited license to use the app on any Apple-branded devices that you own or control, in accordance with Apple’s Media Services Terms and Conditions. This license extends to other accounts associated with Family Sharing or volume purchasing.

3. User Responsibilities

Users must:

• Use the app responsibly and in compliance with applicable laws and regulations.
• Not create, share, or distribute inappropriate, offensive, harmful, or illegal content.
• Respect copyright, intellectual property rights, and the rights of other users.
• Not attempt to reverse engineer, modify, decompile, or interfere with the app’s functionality.
• Not engage in fraudulent activities, including unauthorized access or data scraping.

4. Maintenance and Support

ArtificialStory is solely responsible for providing any maintenance and support services related to the app. Apple has no obligation to furnish maintenance or support for ArtificialStory.

5. Warranty Disclaimer

ArtificialStory is provided "as is" without warranties. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price if applicable. Beyond that, Apple has no further warranty obligations. ArtificialStory disclaims all other warranties to the maximum extent permitted by law.

6. Product Claims

ArtificialStory, not Apple, is responsible for addressing any claims related to:

• Product liability.
• Non-compliance with legal or regulatory requirements.
• Consumer protection, privacy, or similar legal matters, including those related to HealthKit and HomeKit frameworks.

7. Intellectual Property Rights

In the event of any third-party claim that ArtificialStory infringes intellectual property rights, ArtificialStory, not Apple, is solely responsible for resolving the claim.

8. Legal Compliance

By using ArtificialStory, you represent and warrant that:

• You are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country.
• You are not listed on any U.S. Government list of prohibited or restricted parties.

10. Third-Party Terms of Agreement

You must comply with any applicable third-party terms of agreement when using ArtificialStory. For example, if the app involves VoIP services, you must not violate your wireless data service agreement.

11. Third-Party Beneficiary

You acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of this EULA. Upon your acceptance of these terms, Apple has the right to enforce them against you as a third-party beneficiary.

12. Subscription and Payments

Premium features require a subscription:

• Subscriptions are billed monthly through Apple's App Store.
• Automatic renewal occurs unless canceled at least 24 hours before the renewal date.
• Subscription cancellations and refunds are managed in accordance with Apple's App Store policies.
• We reserve the right to modify subscription pricing or features, with prior notice where applicable.

13. Content Rights

• Users retain ownership of the stories they create.
• By using the app, users grant ArtificialStory a non-exclusive, worldwide, royalty-free license to use, display, and store content as necessary for app functionality.
• AI-generated content may be subject to specific legal considerations depending on jurisdiction.
• We do not claim ownership of user-created content but reserve the right to remove any content that violates these terms.

14. Limitations of Liability

ArtificialStory is not liable for:

• Service interruptions, technical issues, or failures beyond our control.
• Data loss, corruption, or security breaches.
• Any indirect, incidental, or consequential damages arising from the use or inability to use the app.
• Any content generated by AI that may be inaccurate, misleading, or inappropriate.

15. Termination and Service Discontinuation

We reserve the right to terminate or suspend access to our services at our discretion, including for violations of these terms. We may also remove content that we determine, in our sole discretion, to be inappropriate, offensive, or in violation of these terms.

Additionally, we reserve the right to discontinue the service at any time, for any reason, without prior notice. In such cases, we shall not be liable for any loss of data, content, or service disruptions that may result from termination or discontinuation.

16. Changes to Terms

We may modify these terms at any time. Continued use of the app after changes are made constitutes acceptance of the new terms. We will notify users of significant changes where feasible.
